Terms of service

The agreement between BookSpace, the customers who book through it, and the hosts and providers who list on it. The final three clauses set out what each side of a booking specifically agrees to.

1.The agreement

These terms govern your use of BookSpace (bookspace.my) and every booking made through it. By creating an account, listing a space or service, or making a booking, you agree to them.

If you use BookSpace on behalf of a business, you confirm you are authorised to bind that business, and “you” means both you and that business.

2.What BookSpace does

BookSpace is a marketplace. We provide the platform on which hosts list spaces, providers list services, and customers book them — including availability, pricing, messaging, payment collection, and booking records.

The booking contract itself is between the customer and the host or provider. We are not the owner, operator, or insurer of any listed space, and we do not perform any listed service. We do not control and are not responsible for the condition, safety, legality, or quality of what is listed, beyond the verification and moderation described in these terms.

3.Accounts and eligibility

You must be at least 18 years old and legally able to enter contracts. One person, one account. You must give accurate details, verify your email address, and keep your password confidential — you are responsible for activity under your account.

Changing your password signs out every other active session. If you believe your account has been accessed without your permission, change your password and contact us immediately.

4.Your personal data

Running a booking platform means holding personal information — your name and contact details, the bookings you make or take, the messages you send through the site, and, for hosts and providers, the bank details we pay you into. How we collect, use, keep and share that is set out in our privacy policy, which forms part of these terms.

A booking necessarily shares some of your details with the other side of it: a host or provider sees the name and contact details they need in order to host you, and you see theirs. Both of you are expected to use those details for that booking and nothing else.

5.Listing a space or service

You build the listing itself and submit it for review; an administrator checks it before it can go live. A listing must accurately describe what is being offered — capacity, pricing, inclusions, address, and photographs of the actual space or work.

You confirm you own the space or have the right to let it, hold any licences or permits your local authority requires, and carry any insurance appropriate to the activity you host. Keeping your calendar and pricing current is your responsibility — an accepted booking is a commitment to honour it. The cancellation policy is not yours to maintain: BookSpace sets one policy for every listing.

We may decline, edit, suspend, or remove any listing that is inaccurate, unlawful, unsafe, or in breach of these terms.

6.Bookings

A booking request reserves a specific date, time window, and package. Depending on the host’s settings, it either confirms immediately or is held pending the host’s approval. Direct bookings with a provider always require the provider’s approval.

Availability is checked again at the moment a booking is written, so two people cannot take the same last slot. A request is only a commitment once it reaches confirmed status, which you can see at any time in My Bookings.

7.Payment and fees

Payments are processed by a licensed third-party payment provider (FPX online banking or card). BookSpace never receives or stores your card number or online banking credentials. All prices are in Malaysian Ringgit and, unless stated otherwise on the listing, exclude any taxes the host is required to charge.

Where a deposit applies, the amount shown as “due now” is charged when you book, and the balance is settled directly with the host or provider by the date they specify — not through BookSpace.

The price shown on a listing is what you pay for the space or service — BookSpace’s own margin is already part of it, not added at checkout. Hosts and providers pay no commission today and receive the full price they list; if that changes we give them 30 days’ notice and it never affects a booking already accepted.

One charge is added on top of that price and shown separately before you pay. The processing fee is 3% of the amount you actually pay through BookSpace — the deposit, not the full booking — with a minimum of RM3 and a maximum of RM99. It covers the payment provider’s charge for taking the payment.

Where a refund is due because you cancelled, everything you paid is returned except the processing fee, which cannot be recovered once collected. The same is true if a host or provider cancels a confirmed booking, or if a government order stops your event from lawfully taking place: everything you paid comes back except that fee, which is spent the moment the payment is taken.

8.Checking a booking before you pay

When a host or provider accepts your request, BookSpace shows you their business name, contact number, address, and the exact date, time and price that were agreed. You are encouraged to contact them directly and confirm those details before you pay — particularly for an event months away.

BookSpace's refund and cancellation policies apply to transactions made through the platform. Any separate arrangement or agreement made directly between a customer and a host or provider outside BookSpace — a different date, a side payment, an off-platform deposit — is the responsibility of the parties involved, and the protections below do not extend to it.

If you have concerns about a host, a provider or a booking, contact BookSpace as soon as possible and before the applicable refund deadline. We may review the transaction and take appropriate action, including cancellation or refund where applicable, and may suspend an account while we investigate. Raising a genuine safety or fraud concern is always worth doing, whatever the timing — deadlines govern what refund you are entitled to, not whether we will look at what happened.

Nothing in these terms limits any right you have under Malaysian consumer law.

9.Cancellations and refunds

BookSpace applies one cancellation policy to every booking on the platform — hosts and providers cannot set their own. You receive a full refund if you cancel within 24 hours of paying, whatever the event date. Between 24 hours and 3 days after paying, a full refund is still available if your event is at least 30 days away — past that point the host can no longer rebook the date, so nothing is refunded. After 3 days from payment nothing is refunded. The clock runs from when you pay, not from the event date. The exact refund amount is shown to you at the moment you cancel, before you confirm.

BookSpace charges no cancellation fee — what the policy says you get back is what you get back. Where a refund is due, everything you paid through BookSpace is returned except the processing fee, which is the payment provider’s charge for taking the payment and is not recoverable once collected.

The refund applies to the money you paid through BookSpace, which where a deposit applies is the deposit rather than the whole booking. Any balance you have paid the host or provider directly is a matter between you and them — BookSpace never receives it and cannot refund it. If a host or provider cancels a confirmed booking, everything you paid through BookSpace is returned except the processing fee, and their terms require them to return any balance you have paid them directly. We can act against their account if they do not, but we cannot refund money that never reached us — tell us if it happens.

If your event is prohibited. Where a government order or other legal restriction stops the event from lawfully taking place, the booking is cancelled and everything you paid through BookSpace is refunded except the processing fee — the timing rules above do not apply, because neither you nor the host chose this, but that fee is spent taking the payment and is never returned. It covers an order that prohibits the event itself. It does not cover a change in your own circumstances, weather, traffic, or a venue simply becoming unavailable, which is the host’s cancellation and is dealt with above. Any balance you have paid the host directly remains between you and them.

Refunds are currently issued manually by our team rather than automatically, because our payment provider does not yet support automated reversals. Allow up to 14 working days for the funds to reach your account.

10.What you earn, and what BookSpace charges

You receive the full price you list. BookSpace takes no commission and deducts nothing from your side of a booking.

If that ever changes. Commission is 0% for everyone listing on BookSpace today. We may introduce one in future — if we do, we will tell you in writing at least 30 days before it starts, and every booking already accepted keeps the terms it was accepted under. You are free to remove your listing at any point, including in response to a change you do not accept.

Our charges are added on top of your price and paid by the customer. There are two: a BookSpace fee of 1% of the booking value, minimum RM5 and no maximum; and a processing fee of 3% of the deposit actually collected, minimum RM3 and maximum RM99. The customer sees one quoted total with our fee already included, plus the processing fee shown separately.

Where a deposit applies, BookSpace collects that share when the booking is confirmed and releases it to you on the first payout run after the customer’s cancellation window closes — see Payouts below. The remaining balance is settled directly between you and the customer — BookSpace never receives it, does not hold it, and cannot collect or chase it on your behalf.

Your deposit percentage is set by BookSpace when your listing is reviewed and cannot be changed on your own. You can request a change from your settings page; we will approve or decline it. A change applies to new bookings only — anything already sold keeps the rate it was quoted at.

11.When a booking is cancelled

BookSpace applies one cancellation policy to every booking on the platform. You cannot set your own, and you cannot vary it for individual customers.

If the customer cancels: they receive a full refund within 24 hours of paying, whatever the date. Between 24 hours and 3 days after paying they are refunded only if the event is still at least 30 days away — close to the date you keep the deposit, because you can no longer rebook. After 3 days from payment they are refunded nothing. The window runs from when they paid, not from the event date. The refund comes out of the deposit BookSpace holds, and your payout for that booking is reduced by the same proportion or cancelled outright. We also return our own charge on the booking, but that part comes out of our margin and does not affect your payout. Where no refund is due, you keep the deposit in full.

If you cancel a confirmed booking: the customer is refunded everything they paid through BookSpace apart from the processing fee, and your payout for that booking is cancelled. The cancellation is recorded against your account. Repeated cancellations may lead to suspension — an accepted booking is a commitment to honour it.

Money a customer has paid you directly. BookSpace never receives it, does not hold it and cannot refund it. But if you cancel, or you cannot provide what was booked, you must return any balance the customer has already paid you, in full and without deduction. That obligation is yours, not ours — we have no way to reverse a payment that never reached us.

Failing to return it is a breach of these terms. We may record it against your account, withhold or deduct from payouts on your other bookings, and suspend or remove your listings. Where a customer cancels and no refund is due under the policy above, what happens to a balance they have already paid you is a matter between you and them.

If the event is prohibited by law: where a government order stops the event from lawfully going ahead, the booking is cancelled and the customer is refunded everything they paid through BookSpace apart from the processing fee. Your payout for that booking is cancelled. Neither of you caused it, so unlike a cancellation of your own it is not recorded against your account and does not count towards suspension.

12.Payouts

Payouts are released weekly, in full and with no commission deducted, to the bank account given during verification. A booking joins a payout run once the customer’s cancellation window has closed — three days after they pay — not when the event happens. You are paid the deposit well before the date you are holding, which is the point of taking one. A booking whose window closes after a week’s run has gone out is included in the following week’s.

Payouts are currently processed manually by our team. The expected date for every payout is shown in your console alongside its amount and status.

We may pause payouts to your account while a dispute, chargeback, or suspected fraud relating to it is being reviewed. A pause stops money leaving without cancelling anything: your bookings and payouts stand, and they resume when the review clears. We tell you the reason on your payouts page when we do it.

13.Acceptable use

You agree not to:

  • list a space or service you have no right to offer, or misrepresent what a booking includes;
  • take bookings or payment off-platform, after a customer has found you through BookSpace, in order to avoid the customer’s processing fee;
  • post false, misleading, discriminatory, or unlawful content, or reviews you did not earn;
  • harass another user, or use the messaging system for spam or solicitation;
  • attempt to scrape, disrupt, reverse-engineer, or gain unauthorised access to the platform or another user’s account.

14.Your content

You keep ownership of the photographs, descriptions, and reviews you upload. You grant BookSpace a non-exclusive, worldwide, royalty-free licence to host, display, resize, and promote that content for the purpose of operating and marketing the platform. This licence ends when you delete the content, except where it is already part of a booking record we are required to retain.

You confirm you have the right to publish everything you upload, including permission from any identifiable person or photographer.

15.Reviews

Only a customer whose booked event has already taken place can review the space or provider from that booking, which is why every rating on BookSpace comes from someone who actually attended. Reviews must be honest and relevant. We do not edit reviews to favour a listing, but we will remove one that is abusive, off-topic, or an attempt at extortion.

16.Disputes between users

If a completed booking did not go as agreed, either side can report an issue from that booking and our team will review it. We may ask both parties for their account of what happened. The outcome is recorded against the accounts involved.

Reporting an issue is not a claim for compensation. We are a booking platform, not an arbiter of quality: we do not decide whether a space or service was good enough, and we do not award money for a booking that took place. Where the event happened and you are unhappy with it, settling that is between you and the host or provider. What a report does is create a record — and repeated or serious reports lead to suspension or removal from BookSpace, which is the sanction that actually protects the next customer.

Two things sit outside this clause. A booking that was cancelled is governed by the cancellation policy above, not by a report. And we keep the right, at our own discretion, to cancel and refund a booking where something warrants it — a listing that was not what it claimed, or a payment taken in error, for example. That is a discretion we hold, not a remedy you are entitled to.

We act as an intermediary here — we are not arbitrating a legal claim, and nothing in this clause prevents you from pursuing your own remedies.

17.Suspension and termination

You may request account closure from your profile page. We review each request and close the account once any bookings still in progress have been completed or cancelled and any money owed to you has been paid out; we will email you when it is done, and you can withdraw the request until then. We may suspend or terminate an account, or remove a listing, where there is a breach of these terms, a legal requirement, a risk to other users, or sustained failure to honour bookings.

Suspension does not cancel confirmed bookings automatically: obligations already owed to a customer, host, or provider survive it, and we will work with the affected parties to resolve them.

18.Disclaimers

The platform is provided on an “as is” and “as available” basis. We work to keep BookSpace accurate and available, but we do not warrant uninterrupted service, or that every listing detail supplied by a host or provider is complete and correct. Nothing here excludes any liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.

19.Limitation of liability

To the extent permitted by law, BookSpace is not liable for indirect or consequential loss, loss of profit, or loss of opportunity arising from your use of the platform or from any booking. Where we are found liable in connection with a booking, our total liability is limited to the processing fee we earned on that booking. This does not limit the liabilities described as non-excludable above.

20.Indemnity

You agree to indemnify BookSpace against claims, losses, and reasonable legal costs arising from your breach of these terms, your content, your use of a booked space, or your provision of a listed space or service.

21.Changes to these terms

We may update these terms as the platform changes. The effective date at the top always reflects the current version, and each published version is kept so you can see what you agreed to and when.

When we change them, you will see a notice on your profile page telling you what has been updated, with links to read it. Confirming there records that you have read the current version. Continuing to use BookSpace after the effective date means you accept the updated terms, whether or not you have confirmed.

22.Governing law

These terms are governed by the laws of Malaysia, and the courts of Malaysia have exclusive jurisdiction over any dispute arising from them. If any clause is found unenforceable, the rest remains in force.

23.Customer and host — space bookings

Booking commitmentRequesting a booking is an offer to reserve the space for the stated date, time, and package. Depending on the host’s settings it confirms instantly or on the host’s approval.

Payment and depositWhere a deposit is required, the amount shown as due now secures the booking. The balance is settled directly with the host by the date they specify, not through BookSpace.

CancellationBookSpace’s platform-wide cancellation policy applies in full; BookSpace adds no cancellation fee of its own, and the host cannot vary the terms. See the cancellations clause above.

Conduct and conditionThe customer uses the space for the stated purpose, respects the capacity and guest limits, and leaves it as it was received. The host provides the space as described for the full booked window.

DisputesEither side can report an issue on a completed booking for our team to review.

24.Customer and provider — direct bookings

Booking commitmentA provider booking is always a request. Nothing is confirmed until the provider approves it, and the provider is expected to respond promptly.

Location and scopeThe customer supplies accurate event details — date, time, and location — and the agreed package scope. Work outside that scope is for the customer and provider to agree separately.

Payment and depositWhere a deposit applies it is charged at booking time; any balance is settled directly with the provider.

CancellationBookSpace’s platform-wide cancellation policy applies in full; BookSpace adds no cancellation fee of its own, and the provider cannot vary the terms. If the provider cancels a confirmed engagement, the customer is refunded everything paid through BookSpace apart from the processing fee. See the cancellations clause above.

ConductThe customer provides a safe, accessible environment for the booked work; the provider delivers the service described in their profile and package.

25.Host and provider — direct hire

Booking commitmentA host hiring a provider for the host’s own event is a request the provider must approve, exactly like a customer’s direct booking.

PaymentNothing is charged until the provider accepts. When they do, BookSpace issues the bill and collects payment from the host the same way it does on any other booking: the quoted price already includes our margin, and the processing fee is added on top and shown separately. Where a deposit applies, any balance is settled directly between the host and the provider.

CancellationEither side can cancel through BookSpace. A direct hire has no cancellation tiers — whoever cancels, the host is refunded everything paid through BookSpace apart from the processing fee, and the provider’s payout for it is cancelled. Any further commercial terms between the two businesses are theirs to agree.

ConductThe host supplies accurate event details; the provider delivers the agreed service.
